JANUARY 23, 2007

Mayor Dale Stanek called a special workshop meeting of the Ely City Council to order at 6:00 p.m. on Tuesday, January 23, 2007 in the Council Chambers at Ely City Hall. Council Members present: Kevin Meskimen, Mark Banowetz, Tom Winkowski and Bob Ballantyne; John Smith –absent, excused. Also present: Ed Brinton of MMS Consultants.
The City Council met in special session, pursuant to notice as required by State Code, to conduct business related to the 2007 Ely Wastewater Treatment Plant Improvements Project and conduct a budget workshop session.
Banowetz, second by Ballantyne, moved to approve the agenda as presented; motion carried – 4 to 0.
2007 Wastewater Treatment Plant Project
Public Hearing re: Authorization of a Loan and Disbursement Agreement and Issuance of Not to Exceed $3,400,000 Sewer Revenue Capital Loan Notes of Ely, Iowa. Clerk/Administrator Anderson reported this item appears on the agenda again because the proper notice was not published previously. Banowetz, second by Winkowski, moved to open a public hearing regarding authorization of a loan and disbursement agreement with the State of Iowa/. Iowa Finance Authority of no more than $3,400,000 in City of Ely sewer revenue bonds; motion carried – 4 to 0. Mayor Stanek declared the public hearing open at 6:02 p.m. Clerk-Administrator Anderson reported this public hearing is required by Iowa Code prior to the City accepting bids and issuing debt for a capital project; and confirmed notice was published as required. Mr. Anderson reported no comments regarding the public hearing item had been received verbally or in writing. Mayor Stanek asked for comments from the public, none were received. Winkowski, second by Meskimen, moved to close the public hearing; motion carried – 4 to 0. Mayor Stanek declared the public hearing closed at 6:04 p.m.
Resolution No. 07-0123-02a, Authorizing Issuance of Sewer Revenue Capital Loan Notes of Ely, Iowa, in an Amount Not to Exceed $3,400,000. Ballantyne, second by Meskimen, moved to approve Resolution No. 07-0123-02a:

Nay: none.
Absent: Smith
Motion carried – 4 to 0.
Resolution No. 07-0123-08, Making Award of Construction Contract for the 2007 Wastewater Treatment Plant Project. Mayor Stanek reported Ed Brinton and Cary Solberg, of MMS Consultants, reviewed the apparent low bid for the 2007 Wastewater Treatment Plant Improvements Project of $2,305,800 received from Miron Construction of Neenah Wisconsin and found the bid to be in conformance with the plans and specifications. Mayor Stanek reported the City’s engineer recommends the contract be awarded to Miron Construction in the amount of $2,305,800.
Ballantyne, second by Meskimen, moved to approve Resolution No. 07-0123-08, Making Award of Construction Contract for the 2007 Wastewater Treatment Plant Project to Miron Construction in the amount of $2,305,800.

Nay: none.
Absent: Smith
Motion carried – 4 to 0.
Budget Workshop Session.
The City Council discussed items related to the FY 2006-07 budget, including the library request, general personnel budget items, and matters related to the water system.
Winkowski, second by Banowetz, moved to adjourn. Motion carried – 4 to 0. The meeting adjourned at 6:52 p.m.
