SPECIALMEETING

Mayor Dale Stanek called a special meeting of the Ely City Council to order at 5:00 p.m. on Thursday, July 19, 2007 in the Council Chambers at Ely City Hall.  Council Members present:  Kevin Meskimen, Tom Winkowski, Bob Ballantyne and Mark Banowetz; John Smith, absent-excused. Also present Cary Solberg of MMS Consultants.

 

The City Council met in special session, pursuant to notice as required by State Code, to discuss options related to extending sanitary sewer from Meadow Place to Jappa Road, and consider a request for preliminary plat, titled Meadow Brook Addition Part Two, to re-subdivide three existing lots.

 

Meskimen, second by Ballantyne, moved to approve the agenda as presented; motion carried – 4 to 0.

 

Discuss Options for Extending Sanitary Sewer from Meadow Place to Jappa Road.

Cary Solberg, of MMS Consultants, presented information to the Mayor and City Council regarding options to extend sanitary sewer main to Jappa Road from Meadow Place.  Options discussed include open trench installation within a utility easement along the north property line of “new” Lot 19 per the proposed Preliminary Plat for Meadow Brook Addition Part Two; open trench installation along Rogers Creek Road; and horizontal bore and “jacking” under Rogers Creek Road.  The general consensus of the City Council was to pursue the option of open trench installation along Rogers Creek Road.

 

Mayor and City Council also discussed reasons this work is being considered and why sanitary sewer was not extended to Jappa Road with installation of improvements for the Meadow Brook Addition.  Items discussed include: Shive-Hattery, the City’s consulting engineer on this matter, did not note sanitary sewer mains not extending to Jappa Rd in their review of the proposed preliminary plat; the City’s written record related to relevant approvals does not refer to the matter; and that the City Council relied on the consulting engineer’s review on such matters.  Meskimen, second by Ballantyne, moved to have the City Administrator send a letter to Shive-Hattery regarding their failure to provide adequate professional services in the review of the preliminary plat for Meadow Brook Addition, and to seek their financial participation to correct the resulting situation.  Motion carried – 4 to 0.

 

Request for Re-Subdivision, Meadow Brook Addition Part Two.

Resolution No. 07-0719-38, Denying Request for Preliminary Plat – Meadow Brook Addition Part Two.  Meskimen, second by Banowetz, moved to approve Resolution No. 07-0719-38, Denying Request for Preliminary Plat – Meadow Brook Addition Part Two. 

Aye: Meskimen, Banowetz, Ballantyne, Winkowski.

Nay:  none.

Motion carried – 4 to 0.

 

Resolution No. 07-0719-37, Approving Development Agreement.  The City Council determined action on this item to be moot, due to denying the subject preliminary plat.
