Ely Planning & Zoning Commission Notes

    Regular Meeting

    Wednesday April 16, 2008 @ 7 PM

 

1) Role Call:

·        Present: Chet Hendrickson, Dean Billick, Chuck Stockdale and Pat Dolphin.

·        Absent and excused: Brian Palas, Eldy Miller and Terry Smith.

·        Others present:  James and Lara Serbousek, Keith Schulte and Aaron Anderson.

 

2)         a) Agenda,

·        Chuck Stockdale made a motion to approve, Pat Dolphin 2nd. 

·        Motion carried - 4 to 0.

 

b) Minutes from Jan 16, 2008.

·        Pat Dolphin made a motion to approve, Dean Billick 2nd.

·        Motion Passed – 4 to 0.

 

3) Comments from Community,

·        James Serbousek discussed his interest in dividing a parcel of land on the north side of Vista Road just west of city limits that he owns. Mr. Serbousek stated the parcel is roughly 9.5 acres, but he would keep approximately 4 to 5 acres for his home and divide the remainder into roughly one-acre lots.  He noted that the Ely Zoning ordinance does not allow agricultural activities on lots that are less than 10 acres, so he expects to split the parcel prior to requesting annexation.  The Commission members discussed the matter with Mr. Serbousek; including that Mr. Serbousek would have to request annexation and R-1 zoning; along with preparing a formal subdivision plat for approval by the City.  Mr. Serbousek left copies of a letter and diagram for the P&Z members.

 

4) Discussion of Development Standards for a Possible “R-3 Multi-Family Residential” Zoning District.

·        The P&Z discussed development standards for a potential “R-3 Multi-Family” residential zoning district that would allow residential structures up to and including 4 separate residential units in a single building.  The P&Z based the discussion on a template based on the R-2 district.  The general consensus was to use R-2 standards, with the following changes:

o        Add “Multi-family not to exceed four (4) family structures” as a permitted use.

o       Add “and R-2” in permitted, accessory and special exception uses.

o       Revise Section 4 – “Special Requirements” by replacing subparagraphs a through e with “provided the requirements of Section 6-13-6.E (4) of this Code are met”

o       Change the title of Section 6 to read “Single, Two and Multi-Family Dwellings”

o       Add a 12 foot side yard requirement for 3 story structures

o       Change the setback for “street side, corner lot” to 25 feet.

o       There should not be separate yard or setback standards for 4-family dwellings.

o       There was considerable discussion regarding the number of off-street parking spaces that should be required.  The general consensus was that the minimum for a four-plex of two bedroom units should be a total of 10 off-street spaces, though did not arrive at a generally agreeable method for setting the required number of off-street parking spaces per family unit in the structure.  The P&Z will take this up at the next meeting.

·        The P&Z will discuss further at the May meeting.

 


5) Discussion: Review & Update Future Land Use Plan.

·        Pat Dolphin moved to postpone this discussion until next meeting, second by Chuck Stockdale. 

·        Motion carried – 4 to 0.

 

6) Motion to adjourn by Dean Billick, Pat Dolphin 2nd.

·        Motion carried – 4 to 0.
