ORDINANCE #192

AMENDING THE ELY ZONING MAP BY DESIGNATING A PARCEL AS A P-1 PUBLIC USE DISTRICT

 

            SECTION 1.  DESIGNATION OF ZONING DISTRICT.  The following legally described parcel is hereby designated as a P-1 Public Use District pursuant to the City of Ely Zoning Ordinance

Beginning at a point on the E-W centerline of Section 31, Township 82 N Range 6W of the 5th P.M. located one thousand five hundred sixty feet (1560 ft.) west of the East ¼ corner of said Section 31-82-6, thence at right angles to said center line of said Section 31-82-6 in a southerly direction, nine hundred feet (900 ft.); thence at right angles to the last described line in a westerly direction a distance of six hundred feet (600 ft.); thence at a right angles to the last described line in a northerly direction a distance of nine hundred feet (900 ft.) to the said E-W centerline of said Section 31-82-6; thence East along said E-W centerline of said Section 31-82-6 a distance of six hundred feet (600 ft.) to point of beginning.  The foregoing parcel contains 12.4 acres, more or less.

 

SECTION 2. REPEALER CLAUSE.  Any ordinance, provision or part thereof, which differs or is inconsistent with this ordinance is hereby repealed, to the extent of said difference or inconsistency.

 

SECTION 3.  SEVERABILITY.  If any section, provision or part of this Ordinance shall be adjudged invalid or unconstitutional by a court of competent jurisdiction, such adjudication shall not affect the validity of the ordinance as a whole, or any section, provision or part thereof not adjudged invalid or unconstitutional

 

SECTION 4.  EFFECTIVE DATE.  This ordinance shall be in effect from and after final passage, approval, posting and publication of this ordinance as required by law. 

 

 

Introduced this 8th day of January 2007, and adopted by the City Council of the City of Ely, Iowa this 8th day of January 2007.
