AMENDING THE ELY ZONING MAP BY DESIGNATING A PARCEL AS AN R-2 MULTI-FAMILY RESIDENTIAL DISTRICT

 

            SECTION 1.  DESIGNATION OF ZONING DISTRICT.  The following legally described parcel is hereby designated as an R-2 Multi-Family Residential District pursuant to the City of Ely Zoning Ordinance

 

THAT PART OF LOT 1 & LOT 2, AUDITOR'S PLAT NO. 512, LINN COUNTY, IOWA, DESCRIBED AS FOLLOWS:

Beginning at the Northwest corner of said Lot 2;

thence North 88° 45’ 10” East  1149.65 feet along the North line of the Northeast Quarter of Southwest Quarter of Section 30, Township 82 North, Range 7 West of the 5th P.M., City of Ely, Linn County, Iowa to the center of said section 30;

thence North 88° 58’ 25” East  518.23 feet along the North line of the Northwest Quarter of Southeast Quarter of said Section 30;

thence South 01° 01’ 37” East  30.00 feet to the beginning of a 300.00 foot radius non-tangent curve, concave Southeasterly;

thence Southwesterly through a central angle of 42° 31' 40" an arc distance of 222.67 feet (chord bearing South 67° 42' 35" West  217.60 feet);

thence South 46° 26’ 45” West  87.14 feet to the beginning of a 500.00 foot radius curve, concave Northwesterly;

thence Southwesterly through a central angle of 40° 05' 55" an arc distance of 349.93 feet (chord bearing South 66° 29' 43" West  342.83 feet);

thence South 86° 32’ 40” West  253.02 feet to the beginning of a 250.00 foot radius non-tangent curve, concave Northeasterly;

thence Southeasterly through a central angle of 40° 02' 40" an arc distance of 174.73 feet (chord bearing South 19° 12' 07" East  171.19 feet);

thence South 39° 13’ 27” East  95.67 feet to the beginning of a 250.00 foot radius curve, concave Southwesterly;

thence Southeasterly through a central angle of 37° 58' 26" an arc distance of 165.69 feet (chord bearing South 20° 14' 14" East  162.68 feet);

thence South 38° 01’ 54” East  354.83 feet to the beginning of a 150.00 foot radius curve, concave Southwesterly;

thence Southeasterly through a central angle of 44° 01' 37" an arc distance of 115.26 feet (chord bearing South 16° 01' 05" East  112.45 feet);

thence South 05° 59’ 43” West  64.57 feet;

thence South 52° 12’ 01” West  97.94 feet to the Northeast line of Northgate 2nd Addition to Ely, Iowa;

thence North 38° 01’ 54” West  1082.40 feet to the Southeasterly line of Lot 3, Auditor’s Plat No. 512;

thence North 50° 59’ 29” East  98.59 feet to the most Easterly corner of Lot 3, Auditor’s Plat No. 512;

thence North 38° 05’ 07” West  1065.05 feet along the Northeasterly line of said Lot 3 to the point of beginning, containing 20.78 acres subject to easements and restrictions of record.

This description has been prepared in accordance with Maps, Plat, Deeds and Surveys of Record.  The composition of these documents account for the differences found in angular and distance relationships.

 

 

SECTION 2. REPEALER CLAUSE.  Any ordinance, provision or part thereof, which differs or is inconsistent with this ordinance is hereby repealed, to the extent of said difference or inconsistency.

 

 

SECTION 3.  SEVERABILITY.  If any section, provision or part of this Ordinance shall be adjudged invalid or unconstitutional by a court of competent jurisdiction, such adjudication shall not affect the validity of the ordinance as a whole, or any section, provision or part thereof not adjudged invalid or unconstitutional

 

SECTION 4.  EFFECTIVE DATE.  This ordinance shall be in effect from and after final passage, approval, posting and publication of this ordinance as required by law. 

 

 

Introduced this 10th day of December 2007, and adopted by the City Council of the City of Ely, Iowa this 14th day of January, 2008.
