ORDINANCE No. 207

AMENDING THE ELY ZONING MAP BY DESIGNATING SPECIFIC LOTS AND PARCELS R-3 MULTI-FAMILY AND R-4 MULTI-FAMILY RESIDENTIAL DISTRICTS

SECTION 1.   DESIGNATION OF R-3 ZONING DISTRICT.  The following legally described parcel is hereby designated as an R-3 Multi-Family Residential District pursuant to Ordinance No. 206 and the City of Ely Zoning Ordinance:

Lots 5, 6, 7, 8 and 9 of Northgate 2^nd Edition to Ely, Linn County, Iowa.

SECTION 2.   DESIGNATION OF R-4 ZONING DISTRICT.  The following legally described parcel is hereby designated as an R-4 Multi-Family Residential District pursuant to Ordinance No. 206 and the City of Ely Zoning Ordinance:

Lots 1, 2, 3, 4, 5, 6, of Northgate 1^st Edition to Ely, Iowa; Lots 10, 11 and 12 of Northgate 2^nd Edition to Ely, Iowa; Parcel A of POS #412 to Linn County, Iowa; and Parcel A, POS #483, Linn County, Iowa.

SECTION 3.   REPEALER CLAUSE.  Any ordinance, provision or part thereof, which differs or is inconsistent with this ordinance is hereby repealed, to the extent of said difference or inconsistency.

SECTION 4.   SEVERABILITY.  If any section, provision or part of this Ordinance shall be adjudged invalid or unconstitutional by a court of competent jurisdiction, such adjudication shall not affect the validity of the ordinance as a whole, or any section, provision or part thereof not adjudged invalid or unconstitutional.

SECTION 5.   EFFECTIVE DATE.  This ordinance shall be in effect from and after final passage, approval, posting and publication of this ordinance as required by law. 

Introduced this 8^th day of September, 2008, and adopted by the City Council of the City of Ely, Iowa this 13^th day of October, 2008.
