ORDINANCE No. 196
AN ORDINANCE TO RESTRICT PARKING AND PROHIBIT TRUCK
TRAFFIC ON DESIGNATED STREETS & IN DESIGNATED LOCATIONS
SECTION
1. PURPOSE. The purpose of this ordinance is to assure
emergency response vehicles are not unduly impeded by parked vehicles, and to
prohibit the use of the identified streets as a through route by trucks and
semi-tractors during the execution of the State Street Bridge Replacement
Project; which the City Council has commissioned and is scheduled to be
conducted June 25, 2007 through September 17, 2007
SECTION 2. NO PARKING ZONES. No person shall stop, stand or park a vehicle in any of the following designated “no-parking zones” except when necessary to avoid conflict with other traffic or in compliance with the direction of a law enforcement officer or traffic control signal:
1. Both sides of Pacific Street
2. Both
sides of Rock Island Drive from State Street to Pacific Street
SECTION 3. THROUGH TRUCK TRAFFIC PROHIBITED. No motor vehicle with three axles or a gross vehicle weight greater than 26,000 pounds when loaded or empty shall travel on the following streets unless for the purpose of making a scheduled or definite stop or delivery to a specific address located on the identified streets:

Rock Island Drive
b.
Pacific Street
c.
Parkview Lane
d.
Parkland Drive
e.
Glendale Lane
f.
Sunrise Drive
SECTION 4.
EMERGENCY VEHICLES. The restrictions created in this ordinance
provision shall not apply to any emergency vehicles, including but not limited
to ambulances or vehicles of the Ely Fire Department, school bus, solid waste
collection vehicle or public works truck owned by the City of Ely.
SECTION 5. CITY SHALL INSTALL SIGNS. The City shall install signs as needed to adequately notify the public of the restrictions created herein.
SECTION 5. DURATION OF ORDINANCE. This Ordinance shall be considered temporary; and the prohibitions enacted hereunder shall take effect June 25, 2007 and shall expire September 17, 2007.
SECTION 6. REPEALER CLAUSE. Any ordinance, provision or part thereof, which differs or is inconsistent with this ordinance is hereby repealed, to the extent of said difference or inconsistency.
SECTION 7. SEVERABILITY. If any section, provision or part of this Ordinance shall be adjudged invalid or unconstitutional by a court of competent jurisdiction, such adjudication shall not affect the validity of the ordinance as a whole, or any section, provision or part thereof not adjudged invalid or unconstitutional
SECTION 8. EFFECTIVE DATE. This ordinance shall be in effect beginning June 25, 2007, following its final passage, approval, and posting and publication of this ordinance as required by law.
