ORDINANCE No. 198

AN ORDINANCE TO PROHIBIT BACKYARD BURNING OF RESIDENTIAL WASTE

 

            SECTION 1.  PURPOSE.  The purpose of this ordinance is to prohibit the backyard burning of residential waste establish at all properties in Ely, by repealing §6-4-25(6) of the Ely City Code. 

 

SECTION 2.  §6-4-25(6) REPEALED.  Section 6-4-25(6) of the Ely City Code is hereby repealed in its entirety.  (web site editor’s note:  §6-4-25(6) is the section of the Ely City Code that allowed backyard burning of residential waste, the repeal of this section removes the authorization that allowed this activity and makes backyard burning of residential waste illegal).

 

SECTION 3. REPEALER CLAUSE.  Any ordinance, provision or part thereof, which differs or is inconsistent with this ordinance is hereby repealed, to the extent of said difference or inconsistency.

 

SECTION 4.  SEVERABILITY.  If any section, provision or part of this Ordinance shall be adjudged invalid or unconstitutional by a court of competent jurisdiction, such adjudication shall not affect the validity of the ordinance as a whole, or any section, provision or part thereof not adjudged invalid or unconstitutional

 

SECTION 5.  EFFECTIVE DATE.  This ordinance shall be in effect following its final passage, approval, publication of this ordinance and installation of signs as required by law.
