ORDINANCE No. 200

AN ORDINANCE TO REQUIRE INSTALLATION OF SIDEWALKS WHEN BUILDING PERMIT REQUESTED FOR WORK ESTIMATED TO BE VALUED AT $10,000 OR MORE

 

SECTION 1.  §6-1-4 ENACTED.  The following is hereby enacted as Section 6-1-4 of the Ely City Code:

6-1-4:  SIDEWALKS REQUIRED.  The owner of any property who seeks approval of a building permit for work estimated to value ten thousand dollars ($10,000.00) or greater shall, if no sidewalk serves the property, install sidewalks abutting public streets, as set out in Title VI, Chapter 8 of this City Code, if all of the following conditions are met:

1.     The lot is adjacent to a public street and curb and gutter are available.

2.     Sidewalks have not been installed abutting the public street for the property prior to the request for building permit.

 

            SECTION 2.  §6-8-7(1) ENACTED.  The following is hereby enacted as Section 6-8-7(1) of the Ely City Code:

6-8-7(1):  The abutting property owner shall install sidewalks as a condition of building permit approval for work valued at $10,000 or more, as set out in §6-1-4 of the Ely City Code.

 

SECTION 3. REPEALER CLAUSE.  Any ordinance, provision or part thereof, which differs or is inconsistent with this ordinance is hereby repealed, to the extent of said difference or inconsistency.

 

SECTION 4.  SEVERABILITY.  If any section, provision or part of this Ordinance shall be adjudged invalid or unconstitutional by a court of competent jurisdiction, such adjudication shall not affect the validity of the ordinance as a whole, or any section, provision or part thereof not adjudged invalid or unconstitutional

 

SECTION 5.  EFFECTIVE DATE.  This ordinance shall be in effect following final passage, approval, and publication of this ordinance as required by law.
