ORDINANCE No. 203

 

AN ORDINANCE TO AMEND REFUSE COLLECTION FEES BY CREATING AN OPTIONAL ANNUAL REFUSE COLLECTION TAG

 

SECTION 1.  §6-5-5.2(a & b) REPEALED.  Sections 6-5-5.2(a & b) of the Ely City Code are hereby repealed in their entirety. 

 

            SECTION 2.  §6-5-5.2(a & b)  ENACTED.  The following is hereby enacted as Section 6-5-5.2(a & b) of the Ely City Code:

 

“2. Rates

“a.       The owner of record shall pay a basic sold waste collection fee of $7.00 per month for each dwelling unit.

 

b.         Ely Refuse Tags shall cost $1.00 each.  Ely Refuse Tags may be purchased at City Hall or from participating merchants.  They must be used for refuse and bulky waste as follows:

 

(1) Regular Trash: One (1) Ely refuse tag to each container with a limit of forty (40) pounds per container.

(2) Tags for large items:  The following items will be accepted for curbside collection provided the customer arranges in advance for collection and the listed number of Ely refuse tags are affixed visibly in a prominent location on the item:

Stove                                                         12 tags

Washer                                                      18 tags

Dryer                                                         12 tags

Straight-back Chair                                   6 tags

Stuffed Chair                                             8 tags

Lamp                                                         4 tags

Sofa                                                           12 tags

Sofa bed                                                    22 tags

Mattress/Box Spring – Twin size  -           8 tags

Mattress/Box Spring – Full, Queen or King Size  - 10 tags

Table –Coffee or Kitchen                          8 tags

Table – “End” or other smaller size          6 tags

Toilet –                                                     18 tags

Dresser –                                                   12 tags

Other bulky items                                      1 tag per 35 pounds

 

c.         Optional Annual Ely Refuse Tag.  Customers may purchase an Annual Ely Refuse Tag enabling collection of one garbage container each week, which would be valid for up to twelve (12) months.  Optional Annual Ely Refuse Tags shall allow for the curbside collection of one garbage container each week, shall be prominently affixed to a garbage container which meets the standards presented herein, and shall be valid through December 31 of each year.  Optional Annual Ely Refuse Tags may be purchased at City Hall.

 

The Optional Annual Ely Refuse Tag shall cost $52.00 for a full 12-month period and all annual tags shall expire December 31 of each year.  The fee for the annual refuse tag shall be as follows for periods less than 12-months:

 

(1) If purchased January 1 through March 31- $52.00

(2) If purchased April 1 through June 30 - $39.00

(3) If purchased July 1 through September 30 - $26.00

(4) If purchased October 1 through December 31 - $13.00

(5) Customers with Annual Refuse Tags who discontinue residential garbage collection service due to moving from Ely, or for any reason allowed by City Ordinance, may receive a refund of $13.00 for each three-month period between the date refuse collection ceases and December 31.  This refund may be in the form of a credit applied to the outstanding balance of a combined utility bill.

 

SECTION 3.  §6-4-13.2 REPEALED.  Section 6-4-13.2 of the Ely City Code is hereby repealed in its entirety.

 

SECTION 4.  §6-4-13.2 ENACTED.  The following is hereby enacted as Section 6-4-13.2 of the Ely City Code:

 

“2.       An Ely refuse tag shall be prominently attached to each collection bag or rigid container placed at curbside.

 

a)     The Optional Annual Ely Refuse Tag shall be prominently attached to the rigid collection container placed at curbside, or prominently displayed at the curbside collection point.

 

SECTION 5. REPEALER CLAUSE.  Any ordinance, provision or part thereof, which differs or is inconsistent with this ordinance is hereby repealed, to the extent of said difference or inconsistency.

 

SECTION 6.  SEVERABILITY.  If any section, provision or part of this Ordinance shall be adjudged invalid or unconstitutional by a court of competent jurisdiction, such adjudication shall not affect the validity of the ordinance as a whole, or any section, provision or part thereof not adjudged invalid or unconstitutional

 


SECTION 7.  EFFECTIVE DATE.  This ordinance shall be in effect following final passage, approval, and publication of this ordinance as required by law.
